USERRA Notice — Your Rights Under USERRA
DOL notice of reemployment, benefits continuation, and nondiscrimination rights for service members. All employers must provide — post or include in the handbook.
Companies Eligible
All employers, any size.
There is no size threshold. USERRA covers every employer with employees who serve in the uniformed services.
What it is
The DOL poster explains reemployment rights, protection from discrimination, and health plan continuation: a service member can continue group health coverage for up to 24 months at up to 102% of the premium, and coverage is reinstated on return with no waiting period.
What needs to be done
- When: Continuously posted, or provided by mail, email or in the handbook.
- To whom: All employees.
- Who performs: HR.
- Customize: None, but replace the file: DOL VETS issued an updated poster dated July 2026, replacing the May 2022 version. Older versions still meet the statutory notice requirement, but the library should carry the current one.
- Deliver: Post where employee notices are customarily placed, or distribute directly.
- Keep: Posting record. For benefits, coordinate USERRA continuation with the COBRA administrator; the periods run concurrently.
